GENERAL CONDITIONS

The current sales terms and conditions of the Company BEST DIVERS SRL, located in Via Naviglio, 15/a, 25086 REZZATO ,V.A.T. No. 03386100170 – CF 01256030386 (hereinafter referred to as “BEST DIVERS SRL”) shall be applied to all orders (hereinafter referred to as “Orders”) from customers (hereinafter referred to as “Customer”) placed by using the order form (hereinafter referred to as “Order Form”), completed on the website page www.bestdivers.it (hereinafter referred to as “Website”). All sales of the merchandise listed on the BEST DIVERS SRL website and in the orders (hereinafter referred to as “Products”) shall also be regulated by the aforementioned sales terms and conditions.

Any terms or conditions other than those in force, shall only be accepted upon written confirmation.
You are kindly requested to carefully read the general sales conditions and memorize or print the content, before sending the order.

The website can be visited without prior registration. However, for placing an order, registration must be completed by filling in the registration form. After having read and accepted the privacy information and Cookies Policy, you will receive an email with your access code, valid for present and future orders.

You can complete your purchase on the order form by using the cart and then view it by clicking on the icon to continue shopping or make changes before proceeding to check out.

The order form contains all essential information regarding each product selected, including quantities and price, payment and delivery method (selected from those provided), shipping costs and a summary of the Sales Terms and Conditions.

Upon transmission of the order form, you unconditionally accept, commit to and confirm to abide by the agreement with BEST DIVERS SRL, as stated in the Sales Terms and Conditions.

Acceptance of orders is always at the discretion of BEST DIVERS SRL. No order will be considered accepted until it has been confirmed by BEST DIVERS SRL.
BEST DIVERS SRL keeps its website up-to-date, but as some products are also present on other marketplace websites, you may run into anomalies in availability.

In the remote case that an item is not available, you will be quickly informed by email and you will be immediately reimbursed for the full amount of the product ordered.
The order form and the confirmation of order will be filed in our database, for the duration required by law.

You can view your order forms by accessing your account.
Any personalized or special request orders cannot be cancelled for any reason, once accepted by BEST DIVERS SRL.

In case of dispute concerning the products sold on the website www.bestdivers.it, the following shall be applied:
– For customers residing in the European Union, the parties can resolve the dispute through an extra-judicial procedure on the European platform (Online Dispute Resolution), without seeking legal counsel, by using the following link: https://webgate.ec.europa.eu/odr/main/?event=main.home.show
– For customers residing outside the European Union, the parties can resolve the dispute through an extra-judicial procedure on “RisolviOnline”, without seeking legal counsel, by using the following link: http://www.risolvionline.com/index.php?lng_id=14

In the event that the parties are not able to resolve the dispute through an extra-judicial procedure, the Italian Court where the customer resides will have jurisdiction.
For customers residing abroad, the Court of Brescia will have jurisdiction.

SHIPPING

DELIVERY TIME
Purchased products will be delivered exclusively from Monday to Friday between the hours of 8:30 a.m. and 6:00 p.m.
Area delivery time:
– Delivery in Italy: within 5 working days from order confirmation and receipt of payment, unless otherwise indicated on the website during holidays and company vacation;
– Delivery abroad: within 15 working days from order confirmation and receipt of payment, unless otherwise indicated on the website during holidays and company vacation;
– BEST DIVERS SRL does not take responsibility for any delay in product delivery due to courier logistical problems or circumstances beyond all control.
SHIPPING CHARGES
Within Italy
– Free above € 20,00 (V.A.T. INCLUDED)
– € 6,90 below € 20,00 (V.A.T. INCLUDED)
Within the EU
– Free above € 39,00 (V.A.T. INCLUDED)
– € 9,90 below € 39,00 (V.A.T. INCLUDED)
Extra CEE
– € 19,90 any amount
Shipping charges are automatically calculated, once the country of destination has been entered.
For deliveries outside the EU, customs duties are at recipient’s charge; the courier indicated by BEST DIVERS SRL will provide the relative invoice upon product delivery.

PACKAGING INSPECTION
Upon delivery, the recipient is required to inspect the packaging to make sure it is intact, not damaged, wet or altered in any way.
If there is any form of damage, the courier must be made aware immediately before he leaves the premises.
Once the parcel has been signed for, without indicating any claim on the delivery note, no complaint will be accepted regarding the exterior conditions of the parcel.
According to Art. 1510 of the C.C., regarding purchases to be shipped, BEST DIVERS SRL is not responsible for any delay or damage caused by the courier.
According to the law, the responsibility of BEST DIVERS SRL ends the moment the package is consigned to the courier. The goods travels at the risk of the receiver

INSPECTION OF THE GOODS WITHIN THE PARCEL
In the case of non-conformity of the goods ordered with those received, BEST DIVERS SRL must be informed immediately by email, at the following address: venditeonline@bestdivers.it

SHIPPING HOLD
In case of failed delivery, after two delivery attempts, BEST DIVERS SRL reserves the right to recall the package.

TERMS OF PAYMENT

Purchased products can be paid for by one of the following methods:

CREDIT CARD
Customers can select one of the major credit cards guaranteed by PayPal to complete the order form.
The payment system is secure, as it uses up-to-date sensitive data encryption systems.
BEST DIVERS SRL will never know your credit card number, which is transmitted directly to the selected service provider through a secure connection.
The amounts will be charged upon transmission of the order form.

PAYPAL
To make a payment through PayPal, you just have to enter your email address, confirm it, and connect a method of payment to your PayPal account.
PayPal requires goods to be shipped only to the address indicated in the transaction.
The amounts will be charged upon transmission of the order form.

WARRANTY AND CANCELLATION POLICY – PRODUCT WARRANTY
The products purchasable on the website are new and therefore under warranty, according to the Italian Consumer Code – Legislative Decree No. 206 dated 6 September 2005 (two-year warranty, according to Italian Law).
The product main characteristics are included in each product description. BEST DIVERS SRL declines all responsibility for any colour discrepancy in the original product, due to a particular configuration or malfunction of the computer used by the customer.
The warranty implies the repair or substitution of the product, within the warranty period, for claims that are well founded and accepted by BEST DIVERS SRL. Claims must be received in writing within 2 months of discovery of the problem.
BEST DIVERS SRL will not accept the following claims:
– Normal wear and tear
– Accidental damage (including dents and bumps)
– Improper use
– Repairs or modifications made by third parties, not authorized by BEST DIVERS SRL in writing

The warranty will be considered valid for those who present the original invoice, along with the product to be repaired.

CANCELLATION POLICY
According to the Legislative Decree No. 206 dated 6 September, 2005, an order may be cancelled for any reason by sending an email to venditeonline@bestdivers.it within and not beyond fourteen days from receipt of the products, as indicated on the delivery note.
Returned products, must be sent to BEST DIVERS SRL – in a single shipment – within fourteen days of the cancellation email.
Cancellation is only possible for products which are returned unaltered, and complete with their original packaging and tag.
Products personalized upon written request from the customer, cannot be returned.
Upon receipt of the returned products, BEST DIVERS SRL will verify their conformity to the terms indicated and if they are in accordance, an email confirmation of the acceptance will be sent to the customer and reimbursement will follow.
